Why Sacramento Clients Trust Law Office of Gilbert B. Vega

Sexual exploitation charges are among the most aggressively prosecuted cases in Sacramento County. The Sacramento County District Attorney’s Office maintains a dedicated unit that prosecutes crimes against children involving the internet and social media, including production and distribution of material covered under PC 311.3 and PC 311.4. You need a criminal defense attorney who knows how this office operates and how these cases are built.

Attorney Vega has secured not-guilty verdicts in serious felony cases, including kidnapping, domestic violence, and first-degree murder, and has had felony charges dismissed entirely. That courtroom record matters when prosecutors know your attorney will take a case to trial. When you work with our firm, you work directly with Attorney Vega from the first call through resolution. No handoffs to staff, no unanswered questions. Past clients describe him as available around the clock and as someone who treats them as a person rather than a case file. He holds a 5-star rating on Avvo and has received the Avvo Top Contributor Award (2013) and the Avvo Client’s Choice Award (2014).

PC 311.3 & PC 311.4: What These Charges Actually Mean

These two statutes are frequently misunderstood or lumped together with possession-based charges. They cover distinct conduct, carry different penalties, and require separate defenses.

PC 311.3: Sexual Exploitation of a Child
Under PC 311.3(a), it’s a crime to knowingly develop, duplicate, print, or exchange any representation, including film, photographs, video, computer files, or digitally altered and AI-generated images, that depicts a person under 18 engaged in sexual conduct. Critically, the prosecution doesn’t need to prove the material is obscene. PC 311.3(b) removes that requirement, which broadens the statute’s reach significantly. Under PC 311.3(c), sexual conduct is defined broadly to include intercourse, oral or anal contact, masturbation, sadomasochistic abuse, exhibition of genitals or the pubic or rectal area, and defecation or urination for sexual stimulation.

PC 311.4: Employing or Coercing a Minor
PC 311.4 is a separate crime targeting anyone who knowingly hires, employs, persuades, induces, or coerces a minor to pose or model for this material, or who uses a minor to help sell or distribute it. The distinction between the two statutes matters for how charges are filed and how sentencing plays out.

Penalties for a Sexual Exploitation Conviction in California

These charges can be filed as misdemeanors or felonies depending on the specific conduct and whether a prior conviction exists.

  • First PC 311.3(a) violation: Up to one year in county jail, a fine of up to $2,000, or both. A subsequent conviction carries state prison time.
  • PC 311.4(a), distribution-related conduct: Up to one year in county jail, a fine of up to $2,000, or state prison.
  • PC 311.4 coercion to produce, without commercial intent: 16 months to three years in state prison.
  • PC 311.4 coercion to produce, with commercial intent: Three to eight years in state prison.
  • Repeat PC 311.4 offenders: An additional fine of up to $50,000.

A conviction under either statute also requires registration as a sex offender under California’s tiered registration system (PC 290). The specific tier depends on how the case is charged and the outcome at sentencing. Sex offender registration is a long-term consequence that can affect where you can live and work.

Defenses in a Sacramento Sexual Exploitation Case

Each case has its own facts, and those facts can create defenses. Here are the ones we examine in PC 311.3 and PC 311.4 cases.

Mistake of Age
The prosecution must prove the accused knew or reasonably should have known the person depicted was a minor. A reasonable, good-faith belief that the individual was 18 or older is a recognized defense under California law.

Shared or Multi-User Devices
When a phone, computer, or cloud account was shared among multiple people, we can challenge whether the accused personally and knowingly developed, duplicated, or exchanged the specific material at issue. Digital evidence isn’t always as straightforward as prosecutors suggest.

Entrapment
A growing number of these cases originate from online sting operations. When law enforcement induced conduct the accused wouldn’t otherwise have engaged in, entrapment can become a viable defense.

Fourth Amendment Challenges
Evidence obtained through an illegal search of a device or online account can be challenged before trial. If the search violated constitutional protections, suppressing that evidence can fundamentally change the prosecution’s case.

Statutory Exemptions
PC 311.3 doesn’t apply to legitimate medical, scientific, or educational activities, lawful conduct between spouses, or unsolicited material received without the accused’s knowledge or consent. These exemptions are written into the statute itself.

Mr.Vega was a great beacon of hope when I was incarcerated last June of 2014. I was charged with some serious crimes and was facing 10 years in prison but Mr.Vega got some charges dropped and got me deal of one year in Sac County with half time so I served 6 months. Mr. Vega did an outstanding job handling a background check error. It almost caused me not to get hired with InShape health clubs. He handled it perfectly and was able to get it cleared up and I was able to start working!! If I am ever in need of an attorney again, I will definitely give him a call. "Regardless of the charges you are facing, he will treat you as a person and not what the paper says about you."

Hiring an attorney can be a stressful process. Mr.Vega was very helpful right from the very first phone call. He is very down to earth, and was able to explain things so that I understood. My husband was facing felony drug charges, and a possible 6 year sentence. He took the case seriously and made us feel like we mattered and that we had a voice. Regardless of the charges you are facing, he will treat you as a person and not what the paper says about you. He was able to get a very good deal that we didn't think was possible and in fact were told by other attorneys was out of the question. My husband was able to get all charges but one dismissed, 1 year of county jail , with half, credit for time served and probation and the ability to apply for early release via the work project program. That's amazing. He was willing to negotiate to come up with a payment plan to fit the needs of everyone involved. I'm 100% happy with his service and would highly recommend him to anyone.

I had 150,000 bail was looking at federal charges and my entire life was in jeopardy...multiple felonies. Mr. Vega reassured me that he would do his best and was with me every step of the way answered every question, every phone call, every time!!! I ended up receiving a misdemeanor and sheriff work release 120 days, after facing 4 years state/ 10 years federal!! Now if my review doesn't convince you then idk what will but he was worth every single penny and I'll love him for life, he saved my life!
